|On Friday, August 28, 2015 at approximately 9:00 PM, several Kingsport Police Officers were providing security and crowd control at the Dobyns-Bennett High School Football Game at J. Fred Johnson Stadium, located at 1800 Legion Drive in Kingsport. Officers received multiple complaints that a white male suspect, later identified as David Michael O’Brien, was following around underage girls and filming their buttocks areas with a white miniature video camera.
Officers were quickly able to track down Mr. O’Brien and found him to be in possession of the described camera. When he refused to allow officers to view the contents of the camera, it was promptly seized as evidence, and Mr. O’Brien was escorted off school property. The camera and resultant investigation were turned over to the K.P.D. Criminal Investigations Division for follow-up.
In the days that followed, a search warrant was obtained to view the contents of the video camera, with numerous video clips found to substantiate the initial complaints. On September 3, 2015 at approximately 2:30 PM, Mr. O’Brien was arrested at the Kingsport Police Department and charged with Unlawful Photography in Violation of Privacy which is a Class A Misdemeanor.
After conferring with Kingsport City Schools Officials, he was formally banned from all Kingsport City School properties and informed that he will be charged with Criminal Trespassing if he returns. Mr. O’Brien was temporarily incarcerated in the Kingsport City Jail, but was soon released on bail after posting a $750 bond as set by the presiding judge.
